Felony Larceny Threshold Legislation

Action
HB113, HB706, and HB1073 set a $1,000 threshold.

Call your Delegates if they’re on the list below, and urge them to support HB113, HB706, and HB1073, to raise the amount of the threshold that results in a felony offense. Individuals should not face serious lifelong consequences for low-level thefts.
Comments
Virginia’s felony threshold (the value of stolen money or goods above which prosecutors may charge theft offenses as felonies, rather than misdemeanors), is the lowest in the nation and has not changed since 1980.

Since 2000, at least 37 states have raised their felony theft thresholds. Thirty states have set theirs at $1,000 or more, including Georgia, South Carolina, Texas, Arkansas, Kansas, Mississippi, and North Carolina and 46 states have set their threshold at $500 or more.

According to a Pew Study, 30 states found that this change had no impact on overall property crime or larceny rates. The amount of a state’s felony theft threshold is not correlated with its property crime and larceny rates.
